A motion hearing took place Monday in St. Joseph Coun ty Circuit Court in the David Locey murder case.
At the hearing, Andy Brown and legal counsel Michael Hill made a motion to quash a previous decision to bind Brown’s case over to circuit court on a murder charge.
A motion to quash is the re versal of a lower court’s ruling, in this case the district court’s ruling to bind Brown over on the murder charge after a preliminary hearing in No vember.
Brown’s counsel also made a motion Monday that a pre vious embezzlement convic tion not be allowed during tes timony. Both motions were denied.
St. Joseph County Prose cutor John McDonough said another motion hearing is to be scheduled regarding the in clusion or exclusion of certain evidence.
A tentative start date for the trial is June 24.
