Constantine Village Council members created an ordinance last week in order to comply with requirements of a resolution it approved previously.
Village manager Mark Honeysett said he was advised by municipal attorney Roxanne Seeber that an ordinance was necessary in order to validate a November resolution for a Tax Increment Financing Authority for the village’s Downtown Development Authority.
Honeysett said Seeber noticed conflicting language in the resolution and determined the ordinance needed to be in place prior to approval of resolution.
The matter was rectified Jan. 20 and the ordinance will now take effect in early February.
It needed to be in place prior to the resolution so that the council knew what they were actually voting on. 9 people, at least 2 professionals, others with years of experience involved and another oops? They messed up. They can’t back-date either document. If the ordinance legally had to come 1st, then the early resolution is voided and has to be presented anew, meeting all the requirements for resolution council consideration. Records need to reflect this. Hope their attorney reminded them of this.
