Hearing on murder case

A motion hearing took place Monday in St. Joseph County Circuit Court in the David Locey murder case.

At the hearing, Andy Brown and legal counsel Michael Hill made a motion to quash a previous decision to bind Brown’s case over to circuit court on a murder charge.

A motion to quash is the reversal of a lower court’s ruling, in this case the district court’s ruling to bind Brown over on the murder charge after a preliminary hearing in November.

Brown’s counsel also made a motion Monday that a previous embezzlement conviction not be allowed during testimony. Both motions were denied.

St. Joseph County Prosecutor John McDonough said another motion hearing is to be scheduled regarding the inclusion or exclusion of certain evidence.

A tentative start date for the trial is June 24.
